ABC News asks judge to toss 'pink slime' lawsuit

(AP) ? Lawyers for ABC News asked a judge Wednesday to toss out a $1 billion defamation lawsuit filed by a South Dakota-based meat processor over a meat product that critics dub "pink slime," saying the news organization did not knowingly disparage the company or its product.

Beef Products Inc. sued ABC News Inc. in September, claiming the network damaged the company by misleading consumers into believing the product is unhealthy and unsafe.

The lawsuit seeks damages under South Dakota's defamation law, as well as a 1994 state law that allows businesses to sue anyone who knowingly spreads false information that a food product is unsafe. The Dakota Dunes, S.D.-based meat processor is seeking $1.2 billion in damages for roughly 200 "false and misleading and defamatory" statements about the product ? officially known as lean, finely textured beef.

The lawsuit named American Broadcasting Companies Inc., ABC News Inc., ABC news anchor Diane Sawyer and ABC correspondents Jim Avila and David Kerley as defendants. It also names Gerald Zirnstein, the U.S. Department of Agriculture microbiologist who named the product "pink slime," former federal food scientist Carl Custer, and Kit Foshee, a former Beef Products Inc. quality assurance manager who was interviewed by ABC.

In the motion to dismiss filed in federal court Wednesday, lawyers for ABC News said that while the term "pink slime" may come across as unappetizing, it is not incorrect. Lean, finely textured beef is both pink and ? like all ground beef ? has a slimy texture, the lawyers argued.

"That term, while unflattering, does not convey false facts about the color or texture of LFTB and is precisely the kind of 'imaginative expression' and 'rhetorical hyperbole' that is constitutionally protected," a memorandum attached to the motion said.

ABC News also contends the meat processor cannot claim harm under the 1994 South Dakota food product law. That law deals only with the safety of the food product, according to the ABC News lawyers, and the reports did not question the product's safety or nutritional value.

"The ABC News reports repeatedly stated that LFTB is safe to eat," the memo with the motion said.

A lawyer for the meat processor said it will oppose the motion to dismiss.

Company officials have long insisted that the product is safe and healthy, and blamed the closure of three plants and roughly 700 layoffs on what they viewed as a smear campaign.

The lean, textured beef trimmings were the subject of many media reports earlier this year, and also have drawn comments from television chefs and food commentators. This year's social media uproar prompted Beef Products to suspend operations at plants in Amarillo, Texas; Garden City, Kan.; and Waterloo, Iowa.

Legal experts have said Beef Products faces an uphill battle because the company must prove ABC knew the stories were false or had doubts about the truth. A judge will make a decision later.

Stepkids trump anniversary plans is that normal? | Step Talk

This is my first entry I am new to this site but am glad I have found refuge and commonality with other people going through the trials of step parenting.

So my DH is gone over half the month due to his career. When he is home he works long hours so I don't really see him unless he has a day off. Maybe takes 5 of those a month max. If those days off fall on a weekend he will drive the 2 1/2 hours to get my SS and SD for the weekend. As you can see we are rarely alone. We also have our own BD. I have gotten used to being the bottom of the totem pole between DH's two jobs, ex-wife, and three children my needs are almost always last. He feels guilty about not being able to see SK more often due to the divorce, the distance, and his job. However, I wonder anymore if he feels bad about the lack of time with our BD let alone me.

Anyway, there is some background. So our third wedding anniversary was over a week ago and he completely forgot. He was out of town for work as usual and never remembered until I told him that night. He apologized and said it wouldn't happen again. When he got back we talked about going out to dinner and a movie this weekend for a belated anniversary celebration. Well, the next day after that conversation it's as if all is forgotten. His ex called him and said my SD has a soccer game and dance performance. He says we are going down to spend two nights where they live in a hotel so we can go to their events. Grant it we just did this same thing four weeks ago and spent $400 to go see them in there home town 2 hours away instead of them coming to our house for the weekend. So I am hurt and mad. Once again he forgot about our anniversary plans and SK were put over me. I understand they need him but I thought one weekend or even one night I could be the priority. He says he feels too guilty about being gone and not part of their life as much as he wants to. He said, "You think I should not see them so we can celebrate our anniversary? I didn't answer but I wanted to say, "Yeah, aren't I worth it? Is that so crazy!" I watch and take care of his kids whenever they are here in the summer and other visits. He is usually gone all day and overnight when they come in the summer so it's all me. Is it crazy to think I might want some time alone with my husband?" He said we will celebrate when he gets back from his next two weeks away. I will believe it when I see it. I'm also just pissed because we pay $1500 in CS and now will be paying another $1000 this month in gas, hotels, and food for everyone to go see them where they live with BM. Why even have a four bedroom house in a state thousand of miles from my home town if we aren't ever going to use it for them. That is why we live where we do versus in the west coast closer to both DH and mine parents. Of course, if I bring up money and the cost of SK he immediately retaliates with don't put a price tag on them how would you feel if you didn't get to see our BD very often. Ugh, it is always something. Guilt drives him and so does his manipulative ex. I am so sick of it and sad of feeling last place.

Am I justified in these feelings?...thoughts,please

Kids' mountain bike program likely the first of many in Old Town ...

Ten children in Old Town learned the joys of mountain biking during a monthlong program for grades 4-8 that ran mid-September through mid-October.

The program was made possible by a first-of-its-kind collaboration of three Maine-based organizations: Old Town Recreation, Maine Winter Sports Center and the Bicycle Coalition of Maine.

?They were very excited to just go out and experience the outdoors,? said Kevin McPhee, director of Old Town Recreation, which hosted the program. ?We have a river trail here in the Old Town-Orono area that goes along the Stillwater River. It?s just a beautiful bike trial, and they were able to experience that on a couple of occasions.?

Biking in the mud was their favorite part.

?They usually came back and had mud up their backs and huge smiles,? McPhee said. ?Their parents would come to pick them up and just shake their heads and smile.?

Healthy Hometowns, the community development program of the Maine Winter Sports Center, provided mountain bikes and helmets for participants, as well as training and curriculum for leaders.

?The focus of this program was on experiencing the lifelong, active outdoor pursuit of mountain biking,? said Central Maine Healthy Hometowns coach Lauren Jacobs. ?Kids had a blast exploring the trails, getting muddy and becoming skilled bikers.?

In April, L.L.Bean announced a $1 million donation to Healthy Hometowns to expand the program into a year-round, statewide effort. This donation coincides with L.L.Bean?s mission to get more children outdoors during their 100th anniversary year and beyond.

?In the past, Healthy Hometowns has been primarily cross-country ski-oriented and mostly in the County, up in Aroostook,? Jacobs said. ?With the funding in April, we can go statewide and year-round. This is the first time we?ve had equipment to use in other regions.?

The funding is providing staff, training and resources for Healthy Hometowns expand its focus to outdoor activities such as paddling, hiking, mountain biking, orienteering and camping.

So far, the donation enabled Healthy Hometowns to purchase 20 mountain bikes, three boat trailers of kayaks, and expand their ski collection to approximately 1,500 sets of skis. The program ?coaches? have started spreading out across the state, and the equipment supply will continue to grow over the next three years, Jacobs said.

The 10 children who participated in the Old Town mountain bike program gained skills and confidence through riding on local trails and fields and engaging in a variety of games and activities used to teach bike handling, shifting, braking, safety and navigating obstacles.

The Bicycle Coalition of Maine, a statewide cycling advocacy group, supported the initiative with a safety program for participants and program leadership by a coalition employee.

?Participants markedly improved their biking skills while getting great exercise and getting the opportunity to experience the great Maine outdoors as it was meant to be enjoyed,? McPhee said.

During the summer, Healthy Hometowns and Old Town Recreation worked together to provide kayaking and biking opportunities to summer camp participants. And this winter, the two organizations will work together for the third year to offer a youth cross-country ski program in conjunction with the Penobscot Valley Ski Club.

?This will be an ongoing effort,? McPhee said. ?We look forward to doing this spring, summer, fall and winter. We look forward to partnering with them each season to provide a different activity.?

Healthy Hometowns trailers filled with cross-country skis and snowshoes will travel throughout the state all winter to give children the chance to experience winter sports. Several schools in the Bangor area have booked the equipment, including schools in Winterport, Hampden, Bangor and Dover-Foxcroft.

?We are really focused on winter right now, planning winter sports, getting out calendars filled up and getting ready to do our ski weeks,? Jacobs said. ?But it won?t be long before we start thinking about spring and getting programming lined up. We already have a couple of requests ? Milo has already scheduled the mountain bikes for their outing club members for some time in May.?

Dow Chemical to slash 2,400 jobs, close 20 plants

MIDLAND, Mich. (AP) ? The Dow Chemical Co. will eliminate about 2,400 jobs and close roughly 20 manufacturing facilities as part of a restructuring plan aimed at coping with slowing economic growth in Europe and elsewhere.

The manufacturing giant said Tuesday that the job cuts amount to 5 percent of the company's workforce worldwide.

Dow expects the strategy will result in roughly $500 million in annual cost savings by the end of 2014.

The company also plans to slash capital spending and investments. It expects that will save an additional $500 million.

All told, Dow anticipates it will save $2.5 billion, including other cost-cutting measures.

Dow produces materials used in nearly every business sector and region of the world, leaving it exposed to shifts in global economic growth.

The company's business has been hurt by Europe's debt crisis and slower growth in China. Manufacturers, construction businesses and some transportation customers have reduced demand for Dow products. The company's coatings and materials for electronic devices also have been weak.

"The reality is we are operating in a slow-growth environment in the near-term and, while these actions are difficult, they demonstrate our resolve to tightly manage operations particularly in Europe and mitigate the impact of current market dynamics," Andrew Liveris, Dow's chairman and CEO, said in a statement.

Rival DuPont Co. on Tuesday reported a big drop in quarterly profit and missed Wall Street expectations. The company announced a restructuring that includes 1,500 layoffs.

Over the next two years, Dow plans to close certain manufacturing facilities in the U.S., Belgium, The Netherlands, Spain, the United Kingdom and Japan.

The company projects it will book between 50 and 60 cents per share in charges related to the restructuring in the fourth quarter of this year. That includes a write-down of assets related to its Dow Kokam LLC joint venture ? a move the company is making due to weak global demand for lithium-ion batteries.

Despite the sweeping cost reductions, Dow plans to continue to invest in areas where it believes that it can clearly expand its profit margins. Those include Dow AgroSciences, Dow Electronic Materials and its Sadara and U.S. Gulf Coast investments.

"Taken on the whole, Dow's strategy remains intact, and our long-term growth fundamentals are strong," Liveris said.

Dow shares ended regular trading down $1.19, or 4 percent, at $28.55 amid a broad market decline. The stock slipped another 24 cents to $28.31 in extended trading.

Forrester survey finds changing notion of 'being online,' less of the old more of the new

A survey measuring people's internet use used to be a fairly simple thing. If you dialed up to your ISP and logged onto CompuServe or AOL, you were "online" until you disconnected. Even in more recent years, you were "online" for as long as you were looking at a web browser or a chat window. But things have gotten more complicated as we've grown more mobile and connected than ever, and that's now resulted in the first ever decline of people "using the internet" in Forrester's annual survey since it began asking the question in 1997. As AllThingsD reports, this year's survey found that people spent an average of 19.6 hours per week using the internet, compared to 21.9 hours in 2011. According to Forrester's Gina Sverdlov, however, that's not due to a shift back towards TV or other activities, but to a changing notion of what "being online" means to individuals. As she puts it, "given the various types of connected devices that US consumers own, many people are connected and logged on (automatically) at all times," and that "the internet has become such a normal part of their lives that consumers don't register that they are using the internet when they're on Facebook, for example." NBC cancels 'Animal Practice'

LOS ANGELES (AP) ? Crystal the monkey is hanging up her doctor's coat.

NBC said Thursday it's pulling the low-rated sitcom "Animal Practice," with the last episode to air Nov. 7.

The series stars Justin Kirk ("Weeds") as a veterinarian at a New York animal hospital. His co-stars include Crystal, a Capuchin monkey with the "Hangover" movie sequel among her credits.

"Animal Practice" had the dubious distinction of annoying Olympic viewers: NBC interrupted the Summer Games' closing ceremony to air the sitcom's debut episode.

This week, "Animal Practice" drew less than 4 million viewers. That compares to the more than 14 million averaged by top-rated sitcom "The Big Bang Theory" on CBS.

"Animal Practice" will be replaced by "Whitney," starring Whitney Cummings, which returns for its second-season debut 8 p.m. Eastern, Wednesday, Nov. 14.

"I take responsibility" for Benghazi: Clinton

LIMA (Reuters) - U.S. Secretary of State Hillary Rodham Clinton assumed responsibility on Monday for last month's deadly attack on the U.S. diplomatic mission in Benghazi, Libya, which has become an issue in the hard-fought U.S. presidential campaign.

"I take responsibility" for what happened on September 11, Clinton said in an interview with CNN during a visit to Peru, adding that President Barack Obama and Vice President Joe Biden would not be responsible for specific security instructions for U.S. diplomatic facilities.

"I'm in charge of the State Department's 60,000-plus people all over the world," Clinton said.

"The president and the vice president wouldn't be knowledgeable about specific decisions that are made by security professionals. They're the ones who weigh all of the threats and the risks and the needs and make a considered decision."

Clinton's comments followed stepped-up criticism of the Obama administration over the Benghazi attack, which Republican presidential challenger Mitt Romney has sought to use to dent Obama's foreign policy credibility before the November 6 election.

Republicans in particular have focused on the Obama administration's shifting explanations for the attack, which Clinton said in two separate television interviews on Monday were the result of "the fog of war."

"Remember, this was an attack that went on for hours," Clinton told Fox News. "There had to be a lot of sorting out. ... Everyone said, here's what we know, subject to change."

The administration initially attributed the violence to protests over an anti-Islam film and said it was not premeditated. Obama and other officials have since said the incident was a terrorist attack.

"POLITICAL GOTCHA"

The Benghazi assault, and the Obama administration's response, has become a contentious election issue and Clinton's comments came a day before the second presidential debate.

"What I want to avoid is some kind of political 'gotcha' or blame game going on," Clinton told CNN.

"I know that we're very close to an election. I want to just take a step back here and say from my own experience, we are at our best as Americans when we pull together. I've done that with Democratic presidents and Republican presidents."

Romney has accused the administration of not providing adequate security to American diplomats and misrepresenting the nature of the attack, which resulted in the death of U.S. Ambassador Christopher Stevens and three other Americans.

Romney's criticisms have sought to undercut the foreign policy record of Obama, who has been praised for the killing of al Qaeda leader Osama bin Laden and the withdrawal of troops from unpopular wars in Iraq and Afghanistan.

Those attacks sharpened after last week's vice presidential debate, when Vice President Joe Biden said "we did not know" of requests by U.S. diplomats on the ground in Libya for more security - a statement that contradicted testimony given two days earlier by State Department officials at a congressional hearing.

Clinton told the networks that Obama and Biden had not been involved in security decisions related to the consulate.

"The decisions about security are made by security professionals. But we're going to review everything to be sure we're doing what needs to be done in an increasingly risky environment," Clinton said.

Congress has increased pressure on the State Department to release information about the attack. Obama and Clinton have both vowed a full investigation.

Elderly Face The Truth About Their Addiction - Retirement Homes

Addiction crosses all age group; it does not discriminate. Older addicts have similar difficulties as young people with alcohol and other drug addictions, plus other issues unique to their age group, says The Partnership at Drugfree.org.

About 3% of Americans seeking addiction treatment are over 60, but the percentage who have addiction problems is suspected of being higher.

Many addicts suffer from estrangement from family, financial problems, and a host of regrets to people in recovery. But elderly addicts can also go through severe isolation and physical changes, including the advent of chronic pain issues. Often, they have more free time, and unstructured time, which is often a negative.

Older addicts like Baby Boomers are arriving at treatment programs. They are the first generation to be involved in widespread recreational use of drugs but before coming out as an addict and seeking help became fashionable. The National Institute on Drug Abuse expects the percentage of seniors with alcohol and other drug problems will dramatically rise by 2020.

There is a silver lining. Older addicts are often are often more successful in quitting. Many are ready to put down their drinking or drug use. Older treatment clients tend to keep their appointments, even if they?re suspicious of the treatment process.

Therapy should be structured around their generational needs:

  • Counselors must be respectful of their privacy
  • Counselors must have good manners when dealing with older clients
  • Sessions should be shorter and held during daylight so seniors don?t have to drive at night

A decade ago, three of four older addicts were battling alcohol abuse, but today about half have problems with drugs other than alcohol.
