Taylor Swift, Cancer-Stricken Fan Have 'Enchanted' Meeting - The ...

Taylor Swift spent time Saturday (Jan. 19) granting the wish of a 17-year-old fan who has spent the last year battling brain cancer. Since December, Kayla Kincannon's (pictured above) family, friends and sympathizers have been tweeting, posting on Facebook, and emailing anyone associated with the music industry, in hopes to setting up a meeting between the brave high school student and "Fearless" singer. This past weekend, that dream came true when Kayla flew to Tennessee to have lunch with Taylor and her mother, Andrea Swift.

"This was no quick meet and greet photo opp," Kayla's father Brad writes on his daughter's blog. "We sat and talked to Taylor and her mom for two hours, had lunch and Kayla received a gift basket, then [Taylor] signed pictures! She is the sweetest, most down to earth person I have ever met! This was more than we ever expected! I'm so thankful to team Kayla, news, and everyone who made her dream come true! This was the best day ever for her and all of us!"

According to Kayla's family, the meeting with Taylor came to fruition through the help of the Michigan teen's friends and social media followers, who were persistent in getting word to the superstar.

"Cannot believe I just had lunch [with Taylor Swift] today, I was enchanted to meet you! Lol" Kayla posted on her Twitter page after the meeting.

(AP Photo/Peter Dejong, File)

All the speculation is about to end. In a matter of hours, viewers can judge for themselves whether Lance Armstrong told the truth this time.

Armstrong's confession to Oprah Winfrey about using performance-enhancing drugs to win the Tour de France a record seven times in a row will be televised at 9 p.m. Thursday, the first segment of a two-part special on the Oprah Winfrey Network. Since word of his confession during Monday's taping in Austin, Texas, was first reported by The Associated Press, there has been no shortage of opinions or advice on what Armstrong should say.

The International Olympic Committee didn't wait to listen.

The IOC on Wednesday stripped Armstrong of his 2000 bronze medal, sending him a letter asking him to return it, according to officials who spoke on condition of anonymity because the decision had not been announced.

For others who will tune in Thursday, it's not just what Armstrong said that matters. How he said it, whether angry, tearful or matter-of-fact, will be judged as well.

"I left it all on the table with her and when it airs the people can decide," Armstrong said of his interview in a text sent to the AP on Wednesday. He dismissed a story earlier in the day that described him as "not contrite" when he acknowledged doping while dominating the cycling world.

Livestrong, the cancer charity Armstrong founded in 1997 and was forced to walk away from last year, said in a statement it expected him to be "completely truthful and forthcoming." A day earlier, World Anti-Doping Agency director general David Howman said nothing short of a confession under oath ? "not talking to a talk-show host" ? could prompt a reconsideration of Armstrong's lifetime ban from sanctioned events. And Frankie Andreu, a former teammate that Armstrong turned on, said the disgraced cyclist had an obligation to tell all he knew and help clean up the sport.

"I have no idea what the future holds other than me holding my kids," Armstrong said in the text.

Armstrong has held conversations with officials from the U.S. Anti-Doping Agency, including a reportedly contentious face-to-face meeting with USADA chief executive Travis Tygart near the Denver airport. It was USADA's 1,000-page report last year, including testimony from nearly a dozen former teammates, that portrayed Armstrong as the leader of a sophisticated doping ring that propelled the U.S. Postal Service team to title after title at the Tour de France. In addition to the lifetime ban, Armstrong was stripped of all seven wins, lost nearly all of his endorsements and was forced to cut ties with Livestrong.

According to a person with knowledge of the situation, Armstrong has information that might lead to his ban being reduced to eight years. That would make him eligible to compete in elite triathlons, many of which are sanctioned under world anti-doping rules, in 2020, when Armstrong will be 49. He was a professional athlete in the three-discipline sport as a teenager, and returned to competition after retiring from cycling in 2011.

That person also said the bar for Armstrong's redemption is higher now than when the case was open, a time during which he refused to speak to investigators. The person spoke on condition of anonymity because he was discussing a confidential matter.

Armstrong, who always prized loyalty on his racing teams, now faces some very tough choices himself: whether to cooperate and name those who may have aided, abetted or helped cover up the long-time use of PEDs.

Armstrong left his hometown of Austin, where the interview was taped at a downtown hotel, and is in Hawaii. He is named as a defendant in at least two pending lawsuits, and possibly a third. The Justice Department faces a Thursday deadline on whether to join a whistle-blower lawsuit filed by former teammate Floyd Landis, who was stripped of the 2006 Tour de France title for doping.

That suit alleges Armstrong defrauded the U.S. government by repeatedly denying he used performance-enhancing drugs. Armstrong could be required to return substantial sponsorship fees and pay a hefty fine. The AP reported earlier that Justice Department officials were likely to join the lawsuit.

Credit card companies still marketing to college students

Visa logo

Credit card companies are still able to get at college students despite tougher laws. Photo Credit: MoneyBlogNewz/Flickr/CC-BY-SA

Part of the provisions of the CARD Act, the law aimed at taming ethically suspect practices of credit card companies, was restrictions on how credit cards could be marketed to college students. Card companies are now finding ways around that.

The Credit card Accountability, Responsibility and Disclosure Act was a concentrated effort by legislators to restrict credit card company practices that many people felt weren?t ethical. One of the provisions of the CARD Act was to prohibit credit card companies and card issuing institutions from marketing heavily to college students, but they are finding ways back onto campus, according to a recent article in the Wall Street Journal. The law prohibits any free promotional gifts to students, but that doesn?t prevent card issuers from offering other things like the $50 bonus for signing up for a card, as Citibank does. Chase decided to market to students on Facebook and offered ?karma? reward points for friending the Chase Facebook group.

No laws broken

Most credit cards are issued by banks, not credit card or finance companies themselves. Banks are still allowed to hand out promotional literature for checking and savings accounts, just not credit cards. However, many people see that as a canard. Most marketing to students by financial services companies appears to be on the level, as a recent survey of college students by the University of Houston Law Center found 73 percent of credit card marketing to students didn?t take place on campus. Students are just as eager to skirt rules in order to get a credit card; the same survey found 29 percent of students who applied for a credit card used their student loan disbursement amounts as the proof of income required for students to get a credit card.

Financial burden of college increasing

The increasing cost of attending a four-year university is an easy inducement for students to get credit cards to experience some comforts, like a meal consisting of more than macaroni and cheese. More students go heavily into debt during college. The Sallie Mae foundation found that 92 percent of college students in 2009 charged an educational expense such as tuition or books and 20 percent of college seniors carried at least $7,000 in credit card debt, according to U.S. News and World Report. The class of 2011, according to Time, carries the highest average college debt ever seen. The class of 2011 carries a $22,900 debt burden on average. That?s an increase of 8 percent from 2010 and a 47 percent increase from 2001.

(AP) ? Same Grand Slam, same court, same result. Only the year was different for Novak Djokovic ? and the amount of time he needed on the bright blue hard surface at Rod Laver Arena.

The Australian Open defending champion took his first step toward winning his third consecutive title at Melbourne Park ? and fourth overall ? with a 6-2, 6-4, 7-5 win over Paul-Henri Mathieu of France on Monday.

The match lasted 1 hour, 42 minutes, more than four hours faster than when the Serbian star was last on center court, his victory in last year's final over Rafael Nadal in a 5-hour, 53-minute marathon.

The win ran Djokovic's winning streak at Melbourne to 15 matches and his overall win-loss record to 33-5. It's no wonder Djokovic calls the Australian Open, site of his first of five Grand Slams in 2008, his favorite major.

"It's great to be back in Australia playing on this court," Djokovic said.

On an opening day when Maria Sharapova and Venus Williams also easily won their first-round matches, Djokovic took his first step to becoming the first man to win three consecutive Australian Open titles in the Open era.

"Any achievement, especially if it's part of history, would mean a lot to me," Djokovic said. "I love this sport. This sport has been my life since I was 4 years old."

Djokovic lost a match to Australia's Bernard Tomic in the exhibition mixed-team Hopman Cup tournament this month, but said his win over Mathieu, who reached a career-high No. 12 ranking in 2008, was a good steppingstone for his second-round match against American Ryan Harrison, a 2-6, 6-4, 7-5, 6-4 winner over Santiago Giraldo of Colombia.

Sharapova finished her first match of the year in 55 minutes, cruising to a 6-0, 6-0 win over Olga Puchkova to start proceedings on center court without showing any signs of trouble with her sore right collarbone.

The No. 2-ranked Sharapova, who lost the final to Victoria Azarenka here last year before going on to win the French Open, faced only two break points in the match and she saved both of those in the first game with aces.

Sharapova withdrew from the Brisbane International earlier this month with a collarbone injury, saying she wanted to concentrate on being fit for Melbourne. She also skipped the Brisbane tournament last year before going on to reach the Australian Open final.

"After a couple of close games and a few break points, I certainly started to concentrate a bit better," she said. "Overall, I was happy with the way I started, considering I didn't play any matches coming in."

Sharapova has a potential third-round match against Venus Williams, who needed just an hour for her opening 6-1, 6-0 win over Galina Voskoboeva of Kazakhstan.

No. 4 Agnieszka Radwanska won the last nine straight games in her opening 7-5, 6-0 win over Australian wild-card Bojana Bobusic 7-5, 6-0, and 2011 U.S. Open champion Samantha Stosur beat Chang Kai-chen of Taiwan 7-6 (3), 6-3 to end a run of five losses on her home courts in Australia.

No. 6 Li Na, who lost the Australian Open final before winning the 2011 French Open, had a 6-1, 6-3 win over Sesil Karatantcheva of Kazakhstan, while No. 11 Marion Bartoli, No. 18 Julia Gorges of Germany and No. 27 Sorana Cirstea of Romania also advanced.

Former French Open champion and 13th-seeded Ana Ivanovic completed women's play for the day with a 6-2, 6-1 win over Melinda Czink of Hungary.

Among the men, fourth-seeded David Ferrer defeated Olivier Rochus of Belgium 6-3, 6-4, 6-2; 2010 Wimbledon finalist Tomas Berdych defeated Michael Russell 6-3, 7-5, 6-3; and No. 10 Nicolas Almagro of Spain beat American qualifier Steve Johnson 7-5, 6-7 (4), 6-2, 6-7 (6), 6-2.

Eighth-seeded Janko Tipsarevic of Serbia came back from two service breaks down in the second set and went on to beat local favorite Lleyton Hewitt 7-6 (4), 7-5, 6-3. It was Hewitt's 17th consecutive Australian Open, a tournament where he's only advanced past the fourth round once ? when he lost in the final to Marat Safin in 2005.

"To his credit, he raised his level and played some great points," Hewitt said of Tipsarevic. "He just played too well on the big points. He was going for everything at 3-0 (down), and it came off."

Also advancing were No. 15 Stanislas Wawrinka of Switzerland, No. 16 Kei Nishikori of Japan, No. 22 Fernando Verdasco of Spain, No. 26 Jurgen Melzer of Austria, 2006 finalist and 28th-seeded Marcos Baghdatis and No. 32 Julien Benneteau of France.

Williams took command of her match early with a steady stream of winners and powerful serves.

She skipped last year's Australian Open due to illness and was warmly welcomed with applause as she entered the court. Williams had the biggest jump of any of the top players in 2012, moving from outside the top 100 to finish the year at No. 24.

"It's hard to play the first match in a major, first thing of the year, and that can be a lot of pressure," Williams said. "I did my best to just close it out."

She's pleased the progress she made last year after a seven-month layoff due to Sjogren's syndrome, an auto-immune disease that can cause fatigue,

"I'm not a patient person," she said. "But I think what I have learned more than anything is for me to focus on the things I can accomplish and not to think about the things that I can't do."

Her younger sister, Serena, was sitting in the crowd with coach Patrick Mouratoglou. Serena is the favorite to win the Australian Open, heading into the tournament with 35 wins in her past 36 matches including titles at Wimbledon, the Olympics and the U.S. Open.

No. 3-ranked Serena Williams is in the top half of the draw with defending champion Azarenka, and the pair won't start until Tuesday.

Second-seeded Roger Federer and No. 3 Andy Murray, the two main threats to Djokovic with Rafael Nadal not playing due to a virus, also play their first-round matches Tuesday.

Notre Dame RB Wood leaving for NFL

SOUTH BEND, Ind. (AP) - ?Notre Dame running back Cierre Wood announced Monday he is entering the NFL draft, deciding against returning for a final year of eligibility.

The 6-0, 215-pound senior, who did not play as a freshman, was second on the team this past season with 742 yards rushing on 114 carries, including 2 yards on four carries in a 42-14 loss to Alabama in the BCS title game. He sat out the first two games of the season after being suspended by coach Brian Kelly for violating team rules.

He rushed for 2,447 yards on 450 carries in three seasons as the Irish, finishing seventh on Notre Dame's all-time list. His 5.4 yards per carry is the most for any Irish back with that many carries. His best season was in 2011, when he led the Irish with 1,102 yards rushing on 217 carries. He rushed for a career-high 191 yards in a game against Purdue in 2011.

Wood, who has a 1-year-old daughter, said it wasn't an easy decision.

"I had to weigh many factors over the last month, but ultimately it came down to what I felt was the right decision that would most benefit my family," he said in a statement released by the school.

Kelly wished Wood well.

"Cierre has been an important member of our football team in my three years at Notre Dame and I appreciate all he did to help get our program back on top," he said.

The Irish also lose leading rusher Theo Riddick, who arrived at Notre Dame in the same recruiting class as Wood. Although Wood came in as a much higher rated recruit, Riddick got on the field immediately as a freshman while Wood struggled to learn blocking schemes and with homesickness. The two, who are close friends and lived in the same house, said there was never any rivalry between them.

The top returning rusher for the Irish is George Atkinson III, a speedy back who ran for 361 yards on 51 carries, an average of 7.1 yards a carry. The Irish will have Amir Carlisle, a transfer from Southern Cal who missed the 2012 season with a foot injury after missing much of his freshman season with the Trojans with injuries. The Irish also are expected to sign several high school backs on Feb. 6, including highly rated backs Greg Bryant from Delray Beach, Fla., and Tarean Folston from Cocoa, Fla.

The announcement comes two days after Kelly said he would return to the Fighting Irish in 2013 after talking with the NFL's Philadelphia Eagles about their head coaching job.

Vilsack to stay on as agriculture secretary

WASHINGTON (AP) -- Agriculture Secretary Tom Vilsack will keep his job in President Obama's second term.

USDA communications director Matt Paul said Monday that Obama asked Vilsack to stay in his post and Vilsack accepted. Vilsack is the former Democratic governor of Iowa.

The farm economy has thrived under Vilsack's tenure, but his job hasn't been as easy in Washington. He is expected to spend the next several months lobbying Congress to pass a farm bill that would extend agriculture subsidies and domestic food aid. Farm-state lawmakers' efforts to pass that bill failed in the last Congress.

Vilsack spent much of his first term working to revitalize rural America. He said in a December speech that rural areas are becoming less relevant as the U.S. population shifts to cities.

Israel PM blocks roads to Palestinian tent site

JERUSALEM (AP) ? Israeli Prime Minister Benjamin Netanyahu closed roads leading to a strategic West Bank site Saturday night in preparation to evacuate Palestinians who pitched tents there to protest plans to build a Jewish housing project.

Palestinian activists erected tents in the area known as E-1 on Friday saying they wanted to "establish facts on the ground" to stop Israeli construction in the West Bank. The activists were borrowing a phrase and a tactic, usually associated with Jewish settlers, who believe establishing communities means the territory will remain Israeli.

Activists said they want to establish a village in the site, which they are calling Bab Al Shams.

Netanyahu's office said Saturday night that the state is petitioning the Supreme Court to rescind an earlier injunction blocking the evacuation. In the meantime, he ordered the area declared a closed military zone and shut off access.

Israel announced it is moving forward with the E-1 settlement after the U.N. recognized a de facto state of Palestine in the West Bank, Gaza and east Jerusalem in November.

Palestinians say E-1 would be a major blow to their statehood aspirations as it blocks east Jerusalem from its West Bank hinterland. Palestinians are demanding these areas, along with Gaza, for their future state.

The construction plans drew unusually sharp criticism from some of Israel's staunchest allies including the U.S. who strongly oppose the E- 1 project.

Israeli officials have said actual construction on the project may be years away if it ever gets off the ground, while Israeli critics have questioned whether Israeli Prime Minister Benjamin Netanyahu actually intends to develop E-1, or is pandering to hard-liners ahead of Israel's Jan. 22 election.

In a separate incident Saturday, the Israeli military said soldiers shot at a Palestinian who "tried to infiltrate Israel" from the West Bank. The military said soldiers called on the man to stop, then fired warning shots in the air, and finally fired at his legs when he refused to stop.

Palestinian police said he later died of his wounds.

It was the second shooting death on the borders with the Palestinian territories in two days. On Friday, Palestinian officials in the Gaza Strip said a man was shot and killed near the coastal territory's border fence. The Israeli military said he was part of a group that rushed the fence to damage it.

Windows RT mod boosts touch response on your Surface

If have are running a touch-based Windows 8 machine, you might have noticed that it can be difficult to select certain elements of the operating system, most notably the ones that are not designed for your fingers: Explorer in desktop mode, for example.

Happily, a new hack has cropped up on the XDA Forums that is worth your testing. TNW implemented the registry change, and found it to be a positive adaptation, but that could be due to the fatness of our fingers. Your mileage will vary.?Specifically, XDA denizens reported improved keyboard response, and better ?small item manipulation.?

However, it is worth trying out. You can find the changes specified below in the following packet. Here are the directions in case you want to implement the new values yourself:

  • Edit key for latency from 8 to 2.
  • Edit sample time from 8 to 2
  • Restart

Users in the thread have reported that the hack will result in decreased battery life, as Windows 8 has to ping the touchscreen more often. If you are a Surface owner, you have enough battery power to make it through, I would guess.

The battery power point is likely the precise reason why Microsoft didn?t itself place the settings in this manner, as it wanted to ensure that devices running its operating system were competitive from a battery life perspective.

It?s Saturday, so you owe it to yourself to try something new. Get to it.

"The War On Terror" Spreads to Africa: U.S. Sending Troops to 35 African Nations

America Sets Its Sights On Controlling African Resources ? And Reducing Chinese Influence. - U.S. Army teams will be deploying to as many as 35 African countries early next year for training programs and other operations as part of an increased Pentagon role in Africa. The move would see small teams of U.S. troops dispatched to countries with groups allegedly linked to al-Qaeda, such as Libya, Sudan, Algeria and Niger. The teams are from a U.S. brigade that has the capability to use drones for military operations in Africa if granted permission. The deployment could also potentially lay the groundwork for future U.S. military intervention in Africa.

Cyber security in 2013: How vulnerable to attack is US now?

Businesses, government, and individuals seek better cyber security measures, as cyberattacks mount in the US. One key focus is how to protect 'critical' systems such as power, water, and transportation.

By Mark Clayton,?Staff writer / January 9, 2013

The phalanx of cyberthreats aimed squarely at Americans' livelihood became startlingly clear in 2012 ? and appears poised to proliferate in 2013 and beyond as government officials, corporate leaders, security experts, and ordinary citizens scramble to devise protections from attackers in cyberspace.

Some Americans came screen to screen with such threats via their smart phones, discovering malicious software (malware) designed to steal their credit-card numbers, account passwords, and even the answers to their secret security questions. Others were temporarily blocked from accessing their bank accounts online, as US bank websites came under major attack at least twice in 2012 by a hacker group with possible ties to Iran. Some citizens learned that their home PCs had become infected by "ransomware," which locks up a computer's operating system until the bad guys get paid ? and often even afterward.

But personal inconvenience is only the beginning. Homeland security is also at stake. The US government in 2012 learned that companies operating natural gas pipelines were under cyberattack, citing evidence that cyberspies, possibly linked to China, were infiltrating the companies' business networks. Those networks, in turn, are linked to industrial systems that control valves, switches, and factory processes. Utilities that operate the nation's electric grid are known to have been another target, as are US tech companies. Crucial government agencies, such as the Pentagon and the Federal Trade Commission, are also targets.

It all adds up to growing evidence ? recognized to varying degrees by the US public, politicians, and businesses ? that cybersecurity is the next frontier of national security, perhaps second only to safeguarding the nation against weapons of mass destruction.

"The cyberthreat facing the nation has finally been brought to public attention," says James Lewis, a cybersecurity expert with the Center for Strategic and International Studies (CSIS), a Washington national-security think tank. "Everyone knows it's a problem. It has moved out of the geek world, and that's a good thing. But it's led to more confusion than clarity. So now we're developing the skills to talk about it ? and it's taking longer than I thought it would."

The awakening to cyberthreats has been gradual. In 2010, news of the world's first cyberweapon ? the Stuxnet computer worm that attacked part of Iran's nuclear fuel program ? burst upon the scene, raising concern about broad replication. Then came an increasing onslaught from hacktivist groups, which often stole and released private data. Between December 2010 and June 2011, for example, members of Anonymous were responsible for cyberattacks against the websites of Visa, MasterCard, and PayPal, as part of a tit for tat over the controversial WikiLeaks website.

Fact or Fiction: Does a Spoon in the Bottle Keep Champagne Bubbly?

A persistent bit of kitchen folklore appears to have little basis in fact

champagne bottle and glassesSPOONERISM: Many people stick a teaspoon into the neck of a sparkling wine bottle in an effort to preserve the wine's fizz. Image: ? iStockphoto/Dawn Poland

  • How does a Venus flytrap know when to snap shut? Can it actually feel an insect?s tiny, spindly legs? And how do cherry blossoms know when to bloom? Can they...

If you had trouble polishing off any open bottles of sparkling wine on New Year?s Eve, you may have employed an old kitchen trick to keep the leftover bubbly ... well, bubbly.

The trick is simple: just put a teaspoon, handle down, into the bottle?s mouth. Many people have cited anecdotal evidence that the spoon helps keep sparkling wines effervescent in the fridge for a day or more after opening.

There?s just one problem. Belief in the spoon tactic, which is of uncertain origin but seems especially prevalent in Europe, appears to be misplaced.

?I think it?s a myth,? says Stanford University chemist Richard Zare, who undertook an extracurricular investigation of the teaspoon?s preservative powers in 1994. Zare, along with food writer and San Francisco Bay Area resident Harold McGee, their wives and other friends, uncorked several bottles of bubbly and refrigerated them for 26 hours under different preservation methods?including some with spoons and some without. Then they sampled and scored the sparkling wines in a blind test. The result: Zare and his fellow testers did not detect any boost in the sparkle of the spooned bottles. A more recent, smaller-scale test on the television show MythBusters arrived at a similar conclusion.

Although Zare's study was somewhat informal, he believes the methodology was solid. ?Hal McGee had just bought a new refrigerator that had nothing in it,? he recalls. ?This was great?because it had no smells or anything in it.? And the bottles of wine, which all came from the same lot, were kept under identical ambient conditions. ?We really tested it quite extensively,? Zare says.

What is more, the California test jibes with the results of a similar experiment conducted around the same time by researchers at the Interprofessional Committee of Champagne. The CIVC, as it is known by its French initials, is an association of grape-growers and winemakers in the Champagne region of France that defends the literal geographic meaning of the appellation ?champagne??bubbly from other locations is sparkling wine. ?The experiment was done in ?pernay, near Reims, with champagne from the same batch, and the pressure was measured in various circumstances, such as opened bottles, opened bottles with spoon, bottle closed with stopper [and] bottle closed with cork (after having been opened),? wrote chemist and food journalist Herv? This in an e-mail; This described the research in his 2006 book, Molecular Gastronomy. ?The pressure in bottles opened and left open or in bottles opened and left open with a spoon decreased in the same way?whereas a stopper or cork prevented the gas escape,? he added.

So if the dangling teaspoon appears to have little to no effect on preserving carbonation, what is a champagne sipper to do with his or her half-empty bottle? No special stopper is needed, says Zare, in whose (admittedly subjective) taste test recorked wine rated poorly. ?Keep it cold. In fact, never let it warm up. That?s the secret,? he says. The reason: in many liquids, including water, carbon dioxide is more soluble at low temperature, so cold liquids better retain their dissolved gas. Some sparkling wines are so saturated with carbon dioxide, Zare says, that they can remain bubbly in the fridge for days, even without a stopper. ?If you keep it cold from the start,? he adds, ?it just goes on and on.?

Republican Party seems as divided, angry as ever

BOSTON (AP) ? The Republican Party seems as divided and angry as ever.

Infighting has penetrated the highest levels of the House GOP leadership. Long-standing geographic tensions have increased, pitting endangered Northeastern Republicans against their colleagues from other parts of the country. Enraged tea party leaders are threatening to knock off dozens of Republicans who supported a measure that raised taxes on the nation's highest earners.

"People are mad as hell. I'm right there with them," Amy Kremer, chairman of the Tea Party Express, said late last week, declaring that she has "no confidence" in the party her members typically support. Her remarks came after GOP lawmakers agreed to higher taxes but no broad spending cuts as part of a deal to avert the "fiscal cliff."

"Anybody that voted 'yes' in the House should be concerned" about primary challenges in 2014, she said.

At the same time, one of the GOP's most popular voices, New Jersey Gov. Chris Christie, blasted his party's "toxic internal politics" after House Republicans initially declined to approve disaster relief for victims of Superstorm Sandy. He said it was "disgusting to watch" their actions and he faulted the GOP's most powerful elected official, House Speaker John Boehner, R-Ohio.

The GOP's internal struggles to figure out what it wants to be were painfully exposed after Mitt Romney's loss to President Barack Obama on Nov. 6, but they have exploded in recent days. The fallout could extend well beyond the party's ability to win policy battles on Capitol Hill. It could hamper Republicans as they examine how to regroup and attract new voters after a disheartening election season.

To a greater degree than the Democrats, the Republican Party has struggled with internal divisions for the past few years. But these latest clashes have seemed especially public and vicious.

"It's disappointing to see infighting in the party," said Ryan Williams, a Republican operative and former Romney aide. "It doesn't make us look like we're in a position to challenge the president and hold him accountable to the promises he made."

What's largely causing the dissension? A lack of a clear GOP leader with a single vision for the party.

Republicans haven't had a consistent standard-bearer since President George W. Bush left office in 2008 with the nation on the edge of a financial collapse. His departure, along with widespread economic concerns, gave rise to a tea party movement that infused the GOP's conservative base with energy. The tea party is credited with broad Republican gains in the 2010 congressional elections, but it's also blamed for the rising tension between the pragmatic and ideological wings of the party ? discord that festers still.

It was much the same for Democrats in the late 1980s before Bill Clinton emerged to win the White House and shift his party to the political center.

2012 presidential nominee Romney never fully captured the hearts of his party's most passionate voters. But his tenure atop the party was short-lived; since Election Day, he's disappeared from the political world.

Those Republican leaders who remain engaged ? Christie, Boehner, Senate Minority Leader Mitch McConnell of Kentucky and Republican National Committee Chairman Reince Priebus ? are showing little sign of coming together.

Those on the GOP's deep bench of potential 2016 presidential contenders, including Florida Sen. Marco Rubio, Wisconsin Rep. Paul Ryan, and Louisiana Gov. Bobby Jindal, have begun staking out their own, sometimes conflicting ideas for the party.

In the short term at least, the party's divisions probably will continue to be exposed.

Obama has outlined a second-term agenda focused on immigration and gun control; those are issues that would test Republican solidarity even in good times. Deep splits already exist between Republican pragmatists and the conservative base, who oppose any restrictions on guns or allowances for illegal immigrants.

It's unclear whether Obama can exploit the GOP fissures or whether the Republican dysfunction will hamper him. With Boehner unable to control his fractured caucus, the White House is left wondering how to deal with the House on any divisive issue.

Fiscal issues aren't going away, with lawmakers were agree on a broad deficit-reduction package. The federal government reached its borrowing limit last week, so Congress has about two months or three months to raise the debt ceiling or risk a default on federal debt. Massive defense and domestic spending cuts are set to take effect in late February. By late March, the current spending plan will end, raising the possibility of a government shutdown.

Frustrated conservative activists and GOP insiders hope that the continued focus on fiscal matters will help unite the factions as the party pushes for deep spending cuts. That fight also may highlight Democratic divisions because the party's liberal wing vehemently opposes any changes to Social Security or Medicare

"Whenever you lose the White House, the party's going to have ups and downs," said Republican strategist Ron Kaufman. "My guess is when the spending issues come up again, the Democrats' warts will start to show as well."

The GOP's fissures go beyond positions on issues. They also are geographical.

Once a strong voice in the party, moderate Republicans across the Northeast are nearly extinct. Many of those who remain were frustrated in recent days when Boehner temporarily blocked a vote on a disaster relief bill.

Rep. Peter King, R-N.Y., said campaign donors in the Northeast who give the GOP after the slight "should have their head examined."

Boehner, who just won a second term as speaker, quickly scheduled a vote on a narrower measure for Friday after the new Congress convened, and it rushed out a $9.7 billion measure to help pay flood insurance claims.

Weary Republican strategists are trying to be hopeful about the GOP's path ahead, and liken the current situation to party's struggles after Obama's 2008 election. At the time, some pundits questioned the viability of the Republican Party. But it came roaring back two years later, thanks largely to the tea party.

"If we have learned anything from the fiscal cliff fiasco, conservatives discovered we need to stand firm, and stand together, on our principles from beginning to end," said Republican strategist Alice Stewart. "It's frustrating to see the GOP drop the ball and turn a position of true compromise into total surrender. The Democrats succeeded in their strategy of divide and conquer."

Denver personal injury lawyer Shaun Kaufman: Historical Legal ...

Mistaken Views on the Internet

Every time a lawsuit is filed against the Aurora Century 16 Theater there are negative comments about that lawsuit posted?around the Internet. A lot of the people making negative comments mistakenly argue that the lawsuits are based in some ?brand new? or novel?theory of law that was brought here from California in the last six months.?This is far from the truth.

An Old and Simple Theory Behind the Lawsuits

Most of the lawsuits that have been filed in this matter use a very old and?simple theory: When a business owner invites?you in to do business with them, and you do business with them, then the business owner has a duty to?the customers to make the business premises safe from known, possible harms.

This rule?has been?on the books?in Colorado (and the United States) for nearly 50 years.

Additionally, if someone was hurt on the business owner?s premises, even by the act of a third party, then the business owner has a duty to protect the customer in the future from similar harm from third parties.?These third parties can be purse snatchers, armed robbers, and auto thieves. The lawsuits filed on behalf of the people at the Aurora Century 16 Theatre argue that it is located in a neighborhood that has a history of robbery, purse snatching, fights gang violence, and other scary?acts. ?They?re right.

1987 Case: Taco Bell v Lannon

In?Taco Bell v. Lannon, a Colorado case decided in 1987,?our Colorado appeals?court said that when considering whether or not it is reasonable to sue a business (like the movie theater) we need to ask only?if?the business owner knew or should have known about the lack of security on the premises. If they knew, or should have known, then they have a duty to protect the patron. Another way of saying this is when?someone operates a business in a neighborhood where there is a lot of crime, then the businessperson assumes responsibility for the safety of those who come to that ?sketchy??neighborhood to do business with him or her.

How Business Owners Safeguard Patrons

Taking good care of customers includes applying such safeguards as:

  • Alarm systems
  • Good lighting in?parking lots
  • Video cameras
  • Safe evacuation policies.

Aurora Century 16 Theatre: A Violent Crime Neighborhood

It is no surprise?to anyone, such as myself, who visited the area around Century 16 Theatre in the past several decades that it is a region where there is a lot of violent crime.

The business owner (theater) knew that. Yet, they did little or nothing to prevent that, and that inaction led to a big problem in July 2012.?Taking good care of?customers isn?t some fancy idea?that just arrived from California. Taking care of customers is good business, and the right thing to do.

(AP) ? De'Anthony Thomas caught the opening kickoff, raced past Oregon's sideline and leaned his head into the end zone like a sprinter crossing the finish line.

The track meet had started and the fifth-ranked Ducks barely looked back after that.

Triggered by Thomas' 94-yard return, Oregon bolted by No. 7 Kansas State 35-17 Thursday night at the Fiesta Bowl in what may have been coach Chip Kelly's final game with the Ducks.

"I felt like my role in this game was to be a momentum-builder and a game-changer," Thomas said. "Once I saw that edge, I wanted to get to the end zone as fast as I could so I could celebrate with my teammates."

They did it a lot.

Teams that had that national title aspirations end on the same day, Oregon and Kansas State ended up in the desert for a marquee matchup billed as a battle of styles: The fast-flying Ducks vs. the execution-is-everything Wildcats.

With Kelly reportedly talking to several NFL teams, Oregon (12-1) was too much for Kansas State and its Heisman Trophy finalist, Collin Klein, turning the game into a try-to-keep up race from the start.

Thomas followed his before-everyone-sat-down kickoff return with a 23-yard touchdown catch, finishing with 195 total yards.

Kenjon Barner ran for 143 yards on 31 carries and scored on a 24-yard touchdown pass from Marcus Mariota in the second quarter. Mariota later scored on a 2-yard run in the third quarter, capped by an obscure 1-point safety that went in the Ducks' favor.

Even Oregon's defense got into the act, intercepting Klein twice and holding him to 30 yards on 13 carries.

"We got beat by a better team tonight, combined by the fact that we let down from time to time," coach Bill Snyder said after Kansas State's fifth straight bowl loss.

Whether Kelly leaves Eugene or not, he had a good run, leading the Ducks to four straight trips to BCS bowls, the last two wins.

Ducks fans sure let him know how they felt, chanting "We want Chip!" just before he was handed the massive Fiesta Bowl trophy.

"Our focus was on this game tonight," Kelly said. "If for some reason, someone wanted to talk to me, it's because of those players over there. We have an unbelievable team, an unbelievable program and any success is because of those guys."

Last year's Fiesta Bowl was an offensive fiesta, with Oklahoma State outlasting Stanford 41-38 in overtime.

The 2013 version was an upgrade: Nos. 4 and 5 in the BCS, two of the nation's best offenses, dynamic players and superbly successful coaches on both sides.

Oregon has become the standard for go-go-go football under Kelly, its fleet of Ducks making those shiny helmets ? green like Christmas tree bulbs for the Fiesta Bowl ? and flashy uniforms blur across the grassy landscape.

Their backfield of Thomas, Barner and Mariota made up a three-headed monster of momentum, each one capable of turning a single play into a scoring drive of 60 seconds or less.

Mariota has been the show-running leader, a question mark before the season who ably ran Oregon's high-octane offense as the first freshman quarterback to start for the Ducks since Danny O'Neil in 1991.

Oregon won the Rose Bowl for the first time in 95 years last season and was in position for a spot in the BCS title game this year before losing a heartbreaker to Stanford on Nov. 17.

Thomas offered the first flash of speed, picking up a couple of blocks and racing toward a not-so-photo finish at the line. The Ducks, are they are apt to do, went for 2 on the point-after and converted on a trick play to go up 8-0 in the game's first 12 seconds.

It was the second straight day a BCS bowl began with a quick strike; Louisville returned an interception for a touchdown against Florida on the first play of the Sugar Bowl Wednesday night.

Thomas hit the Wildcats (11-2) again late in the first quarter, breaking a couple of tackles and dragging three defenders into the end zone for a catch-and-run TD that put the Ducks up 15-0.

It's nothing new for Oregon's sophomore sensation: He had 314 total yards and two long touchdown runs in the 2012 Rose Bowl. The Ducks are used to it, too, after averaging more than 50 points per game.

And they kept flying.

Oregon followed a missed 40-yard field goal by Kansas State's Anthony Cantele by unleashing one of its blink-and-you'll-miss-it scoring drives late in the second quarter. Moving 77 yards in 46 seconds, the Ducks went up 22-10 at halftime after Mariota hit Barner on 24-yard TD pass.

Alejandro Maldonado hit a 33-yard field goal on Oregon's opening drive of the third quarter and Mariota capped a long drive with an easy 2-yard TD run to the left. Kansas State's Javonta Boyd blocked the point-after attempt, but even that went wrong for the Wildcats: Chris Harper was tackled in the end zone for a bizarre 1-point safety that put Oregon up 32-10.

It was the first 1-point safety in major college football since 2004 when Texas did it against Texas A&M, STATS said.

"There were so many things that could have changed the outcome of this game," Kansas State linebacker Arthur Brown said.

Kansas State had gone through its second revival under Snyder, the studious coach who never lost touch with the game or players young enough to be his grandchildren during a three-year retirement.

The 73-year-old followed up the Manhattan Miracle by returning to lead the Wildcats back to national prominence with his attention-to-detail ways.

Klein has led K-State's meticulous march this season, a fifth-year senior who plays in the mold of the college version of Tim Tebow: Gritty, humble, finds a way to win, whatever it takes.

Like the Ducks, the Wildcats had their national-title hopes stamped out on Nov. 17, blown out by Baylor with a rare letdown on both sides of the ball.

Kansas State needed a little time to get its wheels spinning on offense, laboring early before Klein scored on a 6-yard run early in the second quarter.

Klein kept the Wildcats moving in the quarter, though not toward touchdowns: Cantele hit a 25-yard field goal and missed from 40 after a false-start penalty.

Klein hit John Hubert on a 10-yard touchdown pass early in the fourth quarter, but all that did was cut Oregon's lead down to 32-17.

He threw for 151 yards on 17 of 32 passing.

"It wasn't really complicated," Kelly said of slowing Klein. "He's a great player, one of the greats of college football. I had my heart in my throat a couple of times watching him around, but out guys just made plays when they had to make plays."

By doing so, they may have put a nice exclamation point on Kelly's college career.
